ADEQ AZPDES General Permits

Welcome to the Arizona Department of Environmental Quality’s SMART NOI program. This site is designed to provide you with a quick and easy way to file a Notice of Intent (NOI) for stormwater permit coverage, apply for a construction waiver, prepare a Notice of Termination (NOT) to terminate coverage and pay corresponding fee(s) via credit card under the AZPDES Construction General Permit.


As of July 1, 2011 there is a fee for submitting a Notice of Intent (NOI) for coverage under an AZPDES permit, including the Construction General Permit.

 For the Construction General Permit, the fees are:

You can use the SMART NOI System to:

  • Apply for an E-Signature account to expedite coverage.
  • Fill out a Smart NOI even if you don't meet the definition of an authorized signatory (the system lets you complete the form for later signature by the appropriate signatory).
  • Determine CGP Waiver eligibility.
  • Prepare your Notice of Termination (NOT), even if you submitted a paper NOI.
  • Pay for permit coverage (CGP and MSGP), SWPPP review, and CGP waivers by Visa or MasterCard (American Express and Discover are not accepted)

Pursuant to A.R.S. § 41-1030:

(1)    ADEQ shall not base a licensing decision, in whole or in part, on a requirement or condition not specifically authorized by statute or rule. General authority in a statute does not authorize a requirement or condition unless a rule is made pursuant to it that specifically authorizes the requirement or condition.

(2)    Prohibited licensing decisions may be challenged in a private civil action.  Relief may be awarded to the prevailing party against ADEQ, including reasonable attorney fees, damages, and all fees associated with the license application. 

(3)    ADEQ employees may not intentionally or knowingly violate the requirement for specific licensing authority. Violation is cause for disciplinary action or dismissal, pursuant to ADEQ’s adopted personnel policy.  ADEQ employees are still afforded the immunity in A.R.S. §§ 12-821.01 and 12-820.02.
